Blouin Dunn Associate, Kevin Lasko Successfully Argues Summary Judgment Motion

KevinAssociate, Kevin J. Lasko successfully argued a motion for summary judgment on behalf of an insurer dismissing a plaintiff’s claim for unidentified motor vehicle coverage on the basis that the so called “unidentified vehicle” involved in the accident could have been identified.

The court accepted Kevin’s arguments and found that had reasonable steps been taken by the plaintiff or by her lawyers, the vehicle involved in the accident could have and would have been identified negating a claim against the plaintiff’s own insurer.  The court found it unnecessary to address the contentious issue of relief from forfeiture on the premise that a plaintiff cannot forfeit what she is not entitled to in the first place.
